Agreement to terms
Balma is operated by Afterglow Assembly LLC, a Wyoming limited liability company (“Balma,” “we,” “us”). By accessing or using Balma, you agree to these Terms of Service. If you do not agree, please do not use the platform.
Accounts
You must provide accurate information when you create an account, keep your credentials secure, and remain responsible for activity under your account. You must be able to form a binding contract to use Balma, and you agree to use it only for lawful purposes. We may suspend or terminate accounts that violate these terms.
Vendor listings
Venues, practitioners, and producers may create listings and profiles. You are responsible for the accuracy of your listing, for the content and imagery you upload, and for holding the rights to share it. You represent that you are able to provide the services you offer and that your listing is not misleading. We may review, edit, or remove listings that violate these terms or our guidelines.
Bookings and commission
Joining Balma is free. When a booking is made through the platform, we charge a commission on that booking. Applicable commission rates and payment terms are presented before a booking is confirmed. Payments are processed by our third-party payment provider, and you authorize us and that provider to process the amounts due. Contracts for the underlying services are formed between the parties to the booking; Balma facilitates discovery, coordination, and payment but is not itself a party to those service contracts.
Acceptable use
You agree not to misuse the platform, including by attempting to circumvent fees, infringing others’ rights, uploading unlawful or harmful content, or interfering with the platform’s operation or security.
Disclaimers and limitation of liability
Balma is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not guarantee the quality, safety, or legality of any listing, gathering, or service arranged through the platform. To the maximum extent permitted by law, Balma and Afterglow Assembly LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability arising out of or relating to the platform will not exceed the greater of the commissions you paid to us in the three months before the claim or one hundred US dollars (USD 100).
Governing law
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Wyoming will have exclusive jurisdiction over any dispute arising out of or relating to these terms or the platform, subject to any mandatory consumer-protection rights available to you in your place of residence.
